GENERAL TERMS AND CONDITIONS FOR USE OF THE SERVICES OF loominlight.com

Using the services offered by loominlight.com means that you have read and understood these General Terms and Conditions and agree to comply with their provisions. Access to and use of this website and the products and services available through it, collectively referred to as the “Services”, are subject to the following terms, conditions and notices, regulated by these GENERAL TERMS AND CONDITIONS FOR USE OF THE SERVICES OF loominlight.com.

These General Terms and Conditions regulate the relationship between Vezba EOOD, operator of the website loominlight.com, hereinafter referred to as “Vezba EOOD”, “we” or “us”, on the one hand, and the persons using the services provided by loominlight.com, as well as the persons making distance purchases through the online store of Vezba EOOD at loominlight.com, hereinafter referred to as “USERS”, and/or “CUSTOMERS”, and/or “YOU”, on the other hand.

1. GENERAL DEFINITIONS AND PROVISIONS

1.1. The definitions used in these General Terms and Conditions are:

Vezba EOOD is a company registered under the Commercial Act of the Republic of Bulgaria, with registered office and management address: Sofia Region, Sofia Municipality, Sofia, 1233, 12 Karlovo Street, entered into the Commercial Register at the Registry Agency of the Republic of Bulgaria under UIC: 204494512, tel. +359 0877 201 516, e-mail: info@vezba.bg.

SITE means the website, including the online store, operating under the domain: loominlight.com.

SERVICES mean the use of the functionalities of the Site and the execution of distance sales and purchases of goods (items), in accordance with these General Terms and Conditions.

USERS / CUSTOMERS are natural or legal persons that meet these conditions and use services provided by the Site and/or carry out distance purchases as buyers, through the online store loominlight.com.

ORDER means a customer request for a distance sale and purchase of one or more specific items offered in the online store loominlight.com, confirmed by email to the address specified by the customer upon their registration.

DISTANCE SALES CONTRACT is the contract for the sale of goods, concluded at a distance between Vezba EOOD, in its capacity as seller, on the one hand, and any user of the online store, in its capacity as buyer, on the other hand, against payment of the purchase price, under these General Terms and Conditions.

GENERAL TERMS AND CONDITIONS means these GENERAL TERMS AND CONDITIONS FOR USE OF THE SERVICES OF Vezba EOOD.

1.2.

Vezba EOOD reserves the right to manage, regulate, control and modify, as it deems appropriate and at its sole discretion, in general or in particular, the content of the Site and/or the online store, as well as these General Terms and Conditions for the use of the services of loominlight.com, without prior notice.

2. CONSENT TO USE

2.1.

These General Terms and Conditions apply to the free use of the functionalities of the Site, as well as to all orders and distance sales and delivery contracts that may be made and concluded with us. Nothing in these Terms and Conditions affects your statutory consumer rights, including your right to insist that the goods you purchase correspond to their description, are fit for purpose and are of satisfactory quality.

2.2.

By clicking on any link, button or application located on the Site, except for the link pointing to these General Terms and Conditions, USERS explicitly and unconditionally agree with these General Terms and Conditions for the use of certain functionalities of the Site and the online store. The Site can be browsed freely by you without registration.

2.3.

These General Terms and Conditions also govern the delivery of each individual item ordered by you from Vezba EOOD. By ordering a given item, YOU agree to be legally bound by a Distance Sales Contract, regulated by the applicable law and these General Terms and Conditions.

3. SCOPE AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS

3.1.

YOU accept these General Terms and Conditions for an indefinite period of time – from the moment you register and/or use any service provided by Vezba EOOD through the Site or the online store.

3.2.

Using the Site and/or the online store means that YOU have read and agreed to every subsequent amendment to these General Terms and Conditions.

3.3.

Every user of Vezba EOOD is deemed to be bound by a Distance Sales Contract, via the online store operating under the domain: loominlight.com. The Distance Sales Contract is considered concluded from the moment when Vezba EOOD confirms your specific order, according to the conditions for validating orders set out in these General Terms and Conditions, Section VII, Orders.

4. SECURITY AND PRIVACY STATEMENT

4.1. USER ACCOUNT

4.1.1.

Vezba EOOD strives to ensure security and confidentiality when storing your data provided when and in relation to the use of the Site’s services. Vezba EOOD recommends that you keep the confidentiality of the username and password you use to access loominlight.com, in order to avoid unauthorized access through your user account. In this way, upon each access/use of loominlight.com via your account (username and password), it is presumed that you assume responsibility for all actions that will be performed using this account.

4.1.2.

By accessing/using loominlight.com, customers and users agree to take all necessary measures to ensure that the password will not be disclosed to third parties. If you have doubts regarding unauthorized use/misuse of your account, we recommend that you inform us immediately. Upon registration, the information provided must be correct and complete. Please note that you bear responsibility, including criminal responsibility, for any statements/records/false data provided.

4.1.3.

In connection with the provision of certain services, Vezba EOOD requires users to provide specific information such as name, delivery address, email address, age, telephone number, in order to verify the authenticity of users and to send notifications related to services of Vezba EOOD requiring registration. We may use the email address you have provided to send newsletters or updates related to the services we offer.

4.1.4.

Vezba EOOD uses cookies to store your preferences in order to personalize the services offered in accordance with your user profile.

4.1.5.

Vezba EOOD uses reasonable measures to protect any information provided by users of the Site and stored in our database. Access to such information is provided only to our employees who need it in order to perform their work duties. User accounts at Vezba EOOD are protected by passwords. Vezba EOOD guarantees that the information in user profiles is confidential. Please note that we cannot fully guarantee the security of information in case of unauthorized access or use and other factors that may pose a risk to information security at any time.

4.1.6.

Vezba EOOD will treat the personal data of all users as confidential, in strict accordance with the legislation of the European Union governing personal data protection.

4.1.7.

To ensure the security of your payments, we work with Secure Socket Layer (SSL) security technology. This means that when an order is placed on loominlight.com, all information is encrypted. To ensure that your credit or debit card is not used without your consent, we will validate the name, address and other personal information provided by you during the order process against appropriate third-party databases. By accepting these General Terms and Conditions, YOU agree to these checks.

4.1.8.

Vezba EOOD reserves the right to refuse access to loominlight.com to any user, to close an account or to cancel order(s), including confirmed order(s).
Access to loominlight.com may also be temporarily suspended or limited for the purpose of maintenance or introduction of new activities or services.
Vezba EOOD will make every effort to provide access to loominlight.com without interruptions and without errors in electronic transmission. However, due to the nature of the Internet, uninterrupted access and the absence of errors cannot be guaranteed.

4.2. PRIVACY POLICY

4.2.1.

Vezba EOOD understands the importance of personal data privacy. For this reason, every transaction is encrypted and protected to ensure that your data is safe.

4.2.2. Recommendations by Vezba EOOD:

Keep your password safe!
Do not share your password with anyone. A person who knows your password has access to your account.
Avoid using the same password for different accounts.
If you are using a public computer (e.g. in a library or internet café), always make sure you have logged out of your account before turning off the computer.
Change your password frequently.
Do not disclose personal information!

4.2.3.

Vezba EOOD will never ask for your password by phone or email, nor for your credit card number details. Vezba EOOD will not require you to reveal your bank account details or other personal information over the phone. Any such requests by phone or email must be ignored.
If someone makes such a request to you, please contact Vezba EOOD.

4.2.4. Identifying fake emails (spoofing or phishing):

Authentic emails from Vezba EOOD are those sent from email addresses ending in @vezba.bg or @loominlight.com.
Emails that request personal information or direct you to a site other than loominlight.com are not authentic.
Some messages may contain links to websites that direct you to another site, even though the URL contains the word VEZBA EOOD. If you hover over the link, you may see that the URL differs from the one used to identify and access websites owned by Vezba EOOD.

4.3. PERSONAL DATA PROTECTION

4.3.1.

Any information related to personal data provided or collected through operations on loominlight.com will be processed by Vezba EOOD, with registered office in the Republic of Bulgaria, Sofia, 12 Karlovo Street.

Vezba EOOD guarantees the security and confidentiality of the data provided and transmitted through our computer system.

The data and personal information provided by customers/users is used by Vezba EOOD for managing orders, delivering products and services, processing payments, communicating with customers/users regarding orders, products, services and promotional offers, and making product and service recommendations.

Customers/users data is also used to improve the online store and e-commerce platform, to prevent fraud and abuse to the detriment of loominlight.com, as well as to enable third parties to provide technical support, logistics and other services for loominlight.com.

4.3.2.

Vezba EOOD stores all information placed on loominlight.com or otherwise sent by USERS/CUSTOMERS. Most personal data is provided by you when you register your account with Vezba EOOD, search for products on loominlight.com, place orders or send messages, participate in contests or fill out forms on loominlight.com, or when you communicate with employees of Vezba EOOD.

4.3.3.

Personal data means any information used to identify an individual or its equivalent; an identified person is one who can be identified directly or indirectly, in particular by an identification number or one or more specific factors related to their physical, psychological, mental, economic, cultural or social identity.

4.3.4.

Processing of personal data means any operation or set of operations performed on personal data, whether by automatic or non-automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction.

4.3.5.

The data you provide includes: first name, middle name, last name, address, email address and phone number, recipient name (addresses and telephone numbers), and financial data.

Some data is collected automatically by Vezba EOOD, such as the IP address used to connect your computer to the Internet; login; email address; password; information about your computer and methods of connection, such as browser type and operating system version; data which is sometimes combined with similar information collected from other customers in order to generate features such as “Best Sellers”; full URL (Uniform Resource Locator) including date and time, cookie number; viewed or searched products; and any phone number used to call our operators. Vezba EOOD may also use browser data such as cookies, Flash cookies or similar data collected through certain parts of loominlight.com for fraud prevention and other purposes.

4.3.6.

When you visit loominlight.com and use our products, or visit a website where Vezba EOOD publishes advertisements, content or analytics, Vezba EOOD may place a cookie in your web browser. A cookie is a small amount of information stored on your computer with the aim of identifying your browser during interaction with websites. Cookies can be used to store items such as identifiers or user preferences. A website may place a cookie in your browser if your browser settings allow it. A browser may allow a specific website to access cookies and deny such access to other sites.

4.3.7.

Vezba EOOD may also use cookies for other purposes, including:

Accessing information when you log in in order to provide personalized content and store the last viewed page of a product or service of Vezba EOOD.
Providing offers and appropriate content according to your interests.
Internal analysis provided by the customer.
Conducting research to improve the content, products and services of Vezba EOOD.
Supporting security measures, such as requiring re-login for a Vezba EOOD product or service after a certain period of time.
Helping to identify potential fraudulent activities.

4.3.8.

Vezba EOOD provides the possibility of permanent unsubscribing. To use the permanent unsubscribe option, you must log in to loominlight.com before unsubscribing.

You can set your browser to accept all cookies, to reject all cookies, or to notify you when a cookie is placed. Browsers differ from one another, so please refer to your browser’s “Help” menu to learn how to change cookie settings.

If you reject all cookies, you may not be able to use Vezba EOOD products or services that require login and you may not be able to benefit from Vezba EOOD offers.

4.3.9.

Vezba EOOD collects personal data from other sources as well, for example and without limitation, from visited pages of third parties making co-branded operations, via advertisements or otherwise; data, search periods and search results from web search engines, including paid content (e.g. sponsored links).

Data available on loominlight.com such as: updated information on recent orders, personal identification information (including name, email address, password, communication and advertising preferences, address book), suggestions (including history of last viewed products, interaction experience with loominlight.com before confirming an order, as well as preferences).
Customer and user personal data is an important component of the activity of Vezba EOOD.

4.3.10.

Marketing activities through receiving informational or commercial messages (offers, promotions, advertising and marketing messages from Vezba EOOD and third parties with whom Vezba EOOD has relations of any kind) at the email addresses provided by USERS and CUSTOMERS for:

Participation in contests, promotions;
Sending non-commercial or administrative messages (changes in loominlight.com, administration, etc.);
Internal statistics needed for improving service quality and the image of loominlight.com, and for creating new features, elements, promotions, functionalities and new services;
Providing access to restricted sections of loominlight.com;
Market research;
Tracking sales data.

4.3.11.

Vezba EOOD may disclose this information to its distributors and agents under confidentiality agreements to perform certain activities on behalf of Vezba EOOD, including but not limited to: processing and fulfilling orders, delivering orders, analyzing data and information, providing marketing assistance, sending email offers, conducting surveys and sales analyses, processing credit card payments. These providers may have access to the personal data necessary to perform their obligations.

Vezba EOOD will disclose information about your account and other personal data when explicitly required by law or in order to protect its rights, property and security. This includes exchanging information with other companies and organizations for fraud prevention. Of course, this does not include selling, sharing or otherwise disclosing personal data for commercial purposes other than those stated.

On the basis of an email sent to sales@vezba.bg, customers/users may have, free of charge, the following rights:

to intervene in the provision of data;
to object to data processing for legitimate and justified reasons related to their particular situation.

4.4. INTELLECTUAL PROPERTY RIGHTS

4.4.1.

The content of loominlight.com, including design, text, graphics, logos, buttons, icons, images, audio files, digital downloads, data compilations and software, is the property of Vezba EOOD, its representatives or its content suppliers and is protected by the laws of the Republic of Bulgaria and international copyright and database law.

All materials used on loominlight.com (the “Content”) are the property of Vezba EOOD.

Without prejudice to the above, Vezba EOOD may provide the possibility to download wallpapers, screensavers and other utilities from loominlight.com.

4.4.2.

Access to/use of loominlight.com does not grant the customer/user any rights to resell or commercially use loominlight.com or its content.
Customers/users are not entitled to collect or use product lists, descriptions or prices traded by Vezba EOOD, nor to copy loominlight.com or its content.
Any downloading or copying of account information for the benefit of another merchant, as well as the use of automated devices or other means of acquiring or extracting data, is strictly prohibited without the express written consent of Vezba EOOD.

Access to/use of this website does not give the customer/user the right to reproduce, duplicate, copy, sell, resell, visit or otherwise use loominlight.com or any part of it for any commercial purpose without the express written consent of Vezba EOOD.

4.4.3.

Customers/users are not entitled to use the logo, brand or other graphic/drawing of loominlight.com, without the express written consent of Vezba EOOD.

By submitting information or materials through this Site, the customer/user agrees to grant Vezba EOOD the right to use, reproduce, display, modify, transmit and distribute these materials or information. The customer/user also agrees that Vezba EOOD may freely use, for its own benefit, any ideas, concepts, know-how or techniques sent through loominlight.com. Vezba EOOD will not be bound by obligations related to the confidentiality of the information submitted, unless otherwise provided by applicable law.

5. SERVICES OF VEZBA EOOD

5.1.

Within the Site and/or the online store of Vezba EOOD, you may use the following services:

browse the content of the Site and/or online store;
make distance sales and purchases of goods (items);
compile and use data and information provided for certain items.

5.2.

Vezba EOOD manufactures and offers for distance sale high-quality designer clothing and accessories collections, under its own brand and distinctive design.

5.3.

Vezba EOOD pays great attention to the information it provides for each item offered for sale through the online store loominlight.com. The information is accurate and detailed, and contains details regarding available sizes, detailed description of the types of fabrics, the quality requirements applied in production, details on the method of manufacture, including information on handwork used in production or finishing of the items, as well as transformed folklore embroidery motifs from different regions of Bulgaria.

5.4.

In the making or finishing of each item offered by Vezba EOOD, handwork and creative input are used, and in this sense Vezba EOOD does not guarantee full uniformity of each item, which may differ in texture of the fabrics used (stitch placement, natural leather, knit structure) or in the individual approach taken when finishing the garment edges.

5.5.

The images published on the Site are of high quality, in order to present as precisely as possible the texture of the materials and the colors of individual items. However, colors, their brightness and clarity depend on your monitor settings and in this sense Vezba EOOD cannot guarantee that they will match the actual ones perfectly.

5.6.

Vezba EOOD provides its services with both planned and unplanned interruptions. All aspects of the services are subject to change or removal at the sole discretion of Vezba EOOD.

5.7.

Vezba EOOD reserves the right to refuse service temporarily or indefinitely, including the right, at its sole discretion, to cancel unconfirmed orders or remove inactive accounts.

5.8.

The services of Vezba EOOD are provided “as is” and “as available”. Vezba EOOD does not warrant that the services will meet your requirements, or that they will be provided continuously, timely, securely or error-free.

5.9.

Products of Vezba EOOD are accompanied by a description of the embroidery and/or folklore elements used for decoration. The description is provided by the brand’s designer and prepared on the basis of information from books and other sources. It is possible that different sources provide different, non-identical information about embroidery patterns, symbols, used colors, theological meanings, geographical origin, etc. Vezba EOOD is not responsible for discrepancies between the information attached to the products and other information from any type of sources, nor for the theological interpretation of the motifs.

6. REGISTRATION

6.1.

The registration procedure on the Site is completely voluntary and free of charge. Registration is required for carrying out distance purchases through the online store of Vezba EOOD. To register, you must fill in the registration form available on the Site.

6.2.

After completing the registration procedure, YOU create an account at Vezba EOOD. Access to your account is achieved through a username and password chosen by you during the registration process. Registered users can create a list of favorite products, add multiple delivery addresses and choose between them, and receive information and offers from us by email. The required registration data are first name, middle name, last name, delivery address, contact phone number and email address.

6.3.

By successfully completing the registration, YOU confirm that the personal information you provide during the registration process is true, accurate and up-to-date in all respects. Vezba EOOD bears no responsibility for false, incorrect or inaccurate information, true information presented in a misleading manner, as well as for typographical errors.

6.4.

By successfully completing the registration, YOU confirm that:

you are an adult, over 18 years of age;
you have read and accept these General Terms and Conditions.

6.5.

Vezba EOOD is unable to control whether underage users gain access to the services it provides and does not guarantee that minors can make distance purchases through the online store of Vezba EOOD.

6.6.

Please note that YOU are fully responsible for all activities carried out through your account or under your account name. Disclosing your access password to another person is at your own risk.

7. ORDERS

7.1.

To place an order from the online store of Vezba EOOD, the user must select the desired item and specify details regarding size, quantity and delivery conditions. The order is activated to the online store of Vezba EOOD by clicking the “buy” button located under the delivery details of the respective item(s).

7.2.

An order is accepted when we explicitly confirm it by sending an email to the address you have specified, in the form of a document called “order confirmation”, stating that we accept your order. The email confirmation will specify the ordered item, size, quantity, order number, and the date and time when the order was placed.

7.3.

If a certain ordered item is out of stock, a consultant of Vezba EOOD will inform the user when it will be available. If the user does not agree to the delay or substitution with another item (similar model), the order may be cancelled.

7.4.

Orders in the online store of Vezba EOOD (loominlight.com) are accepted 24 (twenty-four) hours a day, 7 (seven) days a week.

7.5.

Orders received from users who have provided incorrect registration data may be cancelled. Vezba EOOD reserves the right to inform users about incorrect or missing data in their profile during order processing and, if no correct data is received from you within 48 (forty-eight) hours, such orders will receive a status of “cancelled” due to impossibility of execution.

7.6.

The order confirmation sent to your email address is considered as conclusion of a Distance Sales Contract between you and Vezba EOOD, operating under the domain: loominlight.com. Our order confirmation is considered effective from the moment it is sent to the email address specified by you in the registration form, regardless of the fact that, for reasons beyond the control of Vezba EOOD, the email may not have reached you.

7.7.

YOU may cancel an order without giving any reasons for the cancellation, no later than the moment of confirmation of the order by Vezba EOOD. An order may be cancelled by sending an email to the following address listed on the Site: sales@loominlight.com. For the cancellation to be valid, it must specify: order number, full name and email address with which you are registered on the Site, as well as the order price.

7.8.

Vezba EOOD may terminate the contract if the item ordered by you is not available for whatever reason. If so, we will inform you and refund in full any amount you have already paid for it.

8. PRICES

8.1.

The prices of items offered by the online store of Vezba EOOD are indicated in Bulgarian leva (BGN) and in euro (EUR). All prices are inclusive of VAT. The prices do not include delivery costs of the ordered items. Any delivery costs are payable in addition to the price of the ordered items and are specified separately.

8.2.

Despite our efforts and attention when describing all details and prices related to the items offered, errors may occur. If you discover an error in the price of ordered items, please inform us as soon as possible and we will give you the opportunity to confirm your order at the correct price or to cancel it.

8.3.

Vezba EOOD reserves the right to correct any errors, inaccuracies or omissions and to change or update information regarding offered items at any time, without notice. Vezba EOOD reserves the right to refuse to fulfill orders that may contain incorrect or inaccurate information, including, without limitation, errors or inaccuracies relating to prices, currency conversion, delivery, payment terms or return of the offered items.

8.4.

If user orders are for delivery outside the EU, please note that your purchase may be subject to import duties and taxes which are payable when the goods reach the destination country. Any such duties and taxes charged in connection with customs clearance shall be borne by the customer. In this sense, Vezba EOOD recommends that customers inform themselves in advance about procedures relating to taxes / duties that may apply in their jurisdiction upon import of goods.

8.5.

Unless otherwise indicated, prices shall be deemed to be for a single unit, inclusive of VAT. Please note that VAT may be charged on deliveries of goods to certain territories.

9. PAYMENT METHODS

9.1.

YOU may pay the price of items ordered from our online store using one of the following methods:

Cash on delivery (COD) – valid only for deliveries within the territory of the Republic of Bulgaria;
Card payment via Stripe;
Bank transfer.

9.2.

By accepting these General Terms and Conditions, YOU give your explicit and unconditional consent to pay in advance to Vezba EOOD the full sale price of the items ordered by you through the online store of Vezba EOOD. In case of bank transfer, please note that you must cover any bank fees or commissions so that the full amount reaches the bank account of Vezba EOOD.

9.3.

To make a distance purchase through the online store of Vezba EOOD, you must have a bank account with which to make the bank transfer, or a valid debit or credit card with which to fund an electronic payment account.

9.4.

Upon receipt of the order, we perform a standard check to ensure that your account covers the value of the order.

9.5.

Vezba EOOD reserves the right to validate the payment information before delivering the ordered items. Please note that if the currency of your payment card differs from the currency of the payment, the amount will be calculated according to the relevant daily exchange rate of the card issuer. If the card issuer refuses to authorize payment to Vezba EOOD, Vezba EOOD shall not be liable for any delay or non-delivery. Vezba EOOD will notify you of any impossibility to complete the delivery.

10. DELIVERY

10.1.

Vezba EOOD aims to deliver the ordered items to customers at an address of your choice, in perfect condition and within the shortest possible time. Vezba EOOD approaches deliveries with particular care in order to prevent any loss or disappointment arising from delivery times.

10.2.

Vezba EOOD makes deliveries without territorial restrictions – worldwide, with the help of reliable partners. Please note that delivery costs are automatically added by Vezba EOOD according to the type of delivery, delivery address, destination country and weight of the shipment.

10.3.

Vezba EOOD makes deliveries to the office of a courier company or to an exact address within the following estimated timeframes:

Express deliveries via courier service within 1 – 14 working days (depending on your location in the world).

10.4.

The estimated delivery times begin from the date of dispatch of the ordered items, and Vezba EOOD is not responsible for any delays caused by local customs clearance procedures. The stated estimated timeframes apply if they do not contradict the delivery times applied by the courier companies with which Vezba EOOD works for different countries.

10.5.

If the ordered items cannot be delivered within the stated estimated timeframes, Vezba EOOD will inform users and will strive to complete delivery as quickly as practically possible. In all cases Vezba EOOD reserves the right, unilaterally and without informing users, to extend the stated timeframes by up to 7 (seven) days.

10.6.

Deliveries are received in the standard way – in person against a signature. If it is impossible or difficult to deliver the shipment personally to the customers, it may be delivered to household members or persons designated by the customer, with their name and relationship to the customer being noted. If the shipment cannot be delivered after two attempts, the Distance Sales Contract is automatically terminated and, as a sanction for non-performance by the customers, Vezba EOOD retains all amounts paid by the customers.

10.7.

Data and information regarding the shipment’s movement and estimated delivery time will be sent to your email address specified in the registration form, together with the order confirmation or later. If YOU have ordered several types of items at the same time, the ordered items may be delivered at different times.

11. DISCOUNTS

11.1.

Discounts may be offered to selected customers in compliance with the privacy and confidentiality policy.

11.2.

Discount privileges may be announced at any time in relation to any item offered by Vezba EOOD.

12.1.

Vezba EOOD strives to achieve complete customer satisfaction. Customer satisfaction is a key priority of Vezba EOOD and in this sense Vezba EOOD pays attention to every return request or individual claim in order to provide the best possible service to its customers.

12.2.

If the delivered items do not correspond to the ordered ones or visible defects or damage are noticed, please contact us immediately at sales@loominlight.com. The Customer Service Department of Vezba EOOD will do everything possible to correct the error or provide a refund or replacement of the items in accordance with our return policy.

12.3.

Vezba EOOD hopes that customers are satisfied with the purchased items and offers a full refund or replacement in cases of claims, returns and/or size exchanges, provided the desired size is available.

12.4.

YOU may return items purchased from Vezba EOOD that have not been worn, used or damaged. To receive a refund or replacement, the items must be kept and returned to Vezba EOOD in excellent condition, without indications of wear, use or damage, with all tags attached, in the original packaging and accompanied by the purchase documents (a copy of the original invoice and/or a copy of the receipt together with the delivery note).

12.5.

Returns and/or exchanges of purchased items are carried out under the following conditions:

YOU must notify Vezba EOOD of your intention to return or exchange a purchased item by sending a request for return or exchange of a particular item to the email address provided by Vezba EOOD: sales@loominlight.com, within 48 (forty-eight) hours of receiving the delivery.
The purchased items must be returned within 14 days from the date of the return request. Claims, returns and/or exchanges of items outside these deadlines will not be accepted.
Please note that returning items is at your own responsibility and the risk of damage or loss is borne by you until the package reaches Vezba EOOD. For this reason Vezba EOOD recommends sending a shipment that insures the value of the returned items.
Please note that all direct costs for returning items are at the customers’ expense.
The value of all successfully returned items that meet the return conditions specified above will be refunded to the customer’s account after deduction of any additional costs such as fees, customs duties and shipping fees paid by Vezba EOOD in connection with receiving the returned items, of which you will be expressly notified. Please note that this process may take up to 30 (thirty) days.

12.6.

Please note that Vezba EOOD offers new and unused items with brand labels and tags attached. Vezba EOOD does not sell used items and will not accept any item that shows any indication it has been used. In such cases, the item will be returned to the customer. Vezba EOOD cannot be held responsible for any item that has not been returned in the condition described above.

12.7.

Please be aware that items made to order are not subject to return. International customs duties and sales taxes cannot be refunded for any deliveries.

13. FORCE MAJEURE

13.1.

Vezba EOOD is not liable to customers for any non-performance of delivery of ordered items, including any delay in delivery or any damage or defect to items caused by any event or circumstance beyond its control, including, without limitation, acts of third parties (hackers, suppliers, governments, supranational or local authorities), riots, uprisings, civil unrest, war, warfare, military operations, national emergencies, terrorism, piracy, arrests, restrictions by a competent authority, strikes, epidemics, fire, explosion, storm, flood, drought, weather conditions, earthquakes, natural disasters and accidents, including mechanical failure of software, failure or problems with public utilities (including electricity, telecommunications or internet services), shortages or impossibility to procure supplies, materials, equipment or transport as a result of a “force majeure event”, regardless of whether they could have been foreseen or not.

14. RESTRICTIONS ON USE

14.1.

All content of the Site and the domain, including but not limited to images, photographs, illustrations, graphics, sound effects, music, audio and video content, computer programs, data compilations, animations and texts published on the Site, as well as other creative works to which YOU have access and which constitute protected works within the meaning of applicable and international copyright and related rights law, are the property of Vezba EOOD. Please note that you assume full responsibility for any use of these works in violation of the rights of Vezba EOOD.

14.2.

The content of the Site loominlight.com is available solely for personal, non-commercial use by users of the Site. Please note that you may download images or graphics of selected parts of the content, provided that they are used solely for your personal, non-commercial use and without in any way affecting the content and scope of the rights of Vezba EOOD.

14.3.

Please note that any unauthorized copying, downloading, reproduction, modification, publishing, distribution, retransmission or creation of derivative works from the protected works of Vezba EOOD for commercial purposes constitutes unlawful use and infringement of the rights of Vezba EOOD, for which legal liability will be sought.

14.4.

Trademarks and logos, registered or unregistered marks of Vezba EOOD, published on the Site are protected by applicable law and international treaties in the field of intellectual property.

15. APPLICABLE LAW, JURISDICTION AND LANGUAGE

15.1.

The use of this Site and any content published on it, including all distance sales contracts concluded as a result of using this Site or the online store, are governed by Bulgarian law. The parties to such a contract agree to submit to the exclusive jurisdiction of the courts of the Republic of Bulgaria.

15.2.

These General Terms and Conditions are drafted in Bulgarian and accompanied by a legalized translation into English. All contracts with consumers who do not understand or do not speak Bulgarian are concluded in English. Regardless of your native language, by completing the registration procedure YOU confirm that you fully understand the meaning of these General Terms and Conditions in English.

16. ADDITIONAL PROVISIONS

16.1.

These General Terms and Conditions may be amended and supplemented at any time, at the discretion of Vezba EOOD, and such changes and/or supplements shall take effect from the moment of their publication on the website of Vezba EOOD.

16.2.

If any provision of these General Terms and Conditions is found to be invalid, illegal, void or otherwise unenforceable under the laws of any state or country in which these Terms are intended to operate and be effective, and is declared invalid, illegal, void or unenforceable within the jurisdiction of that state, such provision shall be deleted, and the remaining provisions shall continue to operate, be enforceable and remain in full force and effect.
